The court stated that on the morning of October 1, 2022, around 4:45 a.m., the actress and the two other accused, Pedro Á.M. and Jorge Sr, were walking along Maria Luisa Avenue in Seville, accompanied by other colleagues, one of them on a bicycle, after having dinner following the completion of a film shoot, «Looking for an open store.»
According to the court’s findings, the police officer involved in the events and his patrol partner stopped the cyclist, who was carrying a drink in one hand and had made a non-regulatory maneuver; They asked him to undergo tests to determine the level of alcohol impregnation, for which they requested the presence of a police vehicle carrying the designated breathalyzer test, and after its completion, the police presence for the breathalyzer test.
During the police action, the actress, as mentioned by the requesting officer, showed signs of being «drunk»; «The officers asked her to identify herself» after persistently recording them with her mobile phone, and since she did not have any documents to prove her identity at that moment, the officers informed her that she would be taken to the police units for identification, so she was escorted to the police vehicle by her own leg.
However, as per the court’s findings, «she started walking towards the police vehicle, Jorge Sr stood in front of it, preventing her from continuing, while the inner agents made gestures for them to return until they finally got out of the vehicle»; At that moment, «an unidentified person opened the back door of the police vehicle, allowing María León to exit.»
Subsequently, the two officers, who were the affected police officer and his partner, «followed her and tried to hold her by the arm, at which point María, moved by the mood to resist police action and assuming a physical deficiency, threw a punch, missed, also pointing at her» saying «you daughter of a puppy, puppy.»
«María shouted not to touch her.»
On the ground, according to the judicial decision, the actress «tried to evade the officers, attempting to flee from them until they caught up with her, holding her against a fence, where the officer tried to handcuff her, with the assistance of two colleagues, while «María cried.»
At that moment, «another person, with total disregard for the principle of authority and also assuming a possible physical disability towards the police officer, held onto the protective vest he was wearing, shaking it forcefully to prevent him from searching María, when it was a stop, when it was just a stop»; Although «it was not proven that the author of such actions was Pedro Á.M.»
Finally, the sentence states that, before the trial, the actress «paid the amount of 150 euros.»
After the three accused denied the accusations during the trial, the court considered that, regarding the actress’s situation, «the testimony of the officers must be addressed,» because «their account is detailed, coherent, and consistent in essential aspects concerning the sequence of events»; While the «accused’s version is not credible, considering the fact that she claimed that several people threw her to the ground and handcuffed her behind her back, which is not consistent with the visual evidence, as seen, as emphasized by the officers, that the arrest took place,» among other aspects.
Judicial Decision
In light of the case, the court fully acquits Pedro Á.M. and Jorge Sr of the alleged crimes of assault, resistance, and disobedience they were facing.
Regarding María León, she is acquitted of the disobedience charge but is convicted of resistance and minor injuries with the mitigating factor of having paid the damages prior to the trial, with the court imposing two fines totaling 5,700 euros and the obligation to compensate with one hundred euros.
This ruling comes in a context where the prosecutor had requested one year and nine months of imprisonment for an alleged assault and 720 euros for this offense, as well as for a minor injury offense, and the officer was compensated with 100 euros; Meanwhile, the officer had demanded a sentence for assault, disobedience, and minor injuries, with a request for two years and one day of imprisonment, a fine of 9,000 euros, and payment of compensation of 1,150 euros.
Of course, the ruling may be appealed before the provincial court of Seville, with a specific deadline of ten days for this.
