La madre del acusado asegura que su hija le dijo que la víctima la amenazó con un arma el día del crimen.

Los dos acusados del asesinato de La Puebla, en Cartagena (Murcia), habían «planeado» matar a la víctima y «prenderle fuego», según señaló la hermana del acusado durante su comparecencia como testigo en la tercera audiencia del nuevo juicio que se desarrolla en la sección quinta de la Audiencia Provincial con sede en la ciudad portuaria.

En concreto, ha recordado que el acusado le dijo antes de cometer el hecho que iba a matar a la víctima y que la iba a «prender fuego». En definitiva, iban a hacer «básicamente lo que le hicieron» al fallecido.

La testigo declaró que no conoció estos planes directamente a través de su hermana, sino que el imputado se lo contó al otro imputado y fue él quien finalmente se lo transmitió a ella.

«They both threatened the victim and told him they were going to kill him,» according to the witness, who indicated that the deceased showed her messages in which the accused threatened him. In fact, he told the victim – with whom he had a closer relationship than his sister – to report the situation and that she could not give her consent.

She indicated that on the day of the incident, the two accused were «fine», although at one point they communicated in secret. She also recalled that both asked for a key under the pretext of wanting to enter an occupied house, but their mother denied it to them.

Asked if they had any escape plan, she recalled that the day before the incident they told her they were heading to a town in Granada. «They told me they were going on a trip,» she clarified.

She also noted that her sister «had her days, like everyone else,» although she denied that she hated the victim. On the other hand, she affirmed that the other accused hated the deceased.

Finally, she admitted that her sister had told her she had burned the car of the other accused’s brother. Additionally, she admitted that she knew the accused was a drug user and had smoked cocaine the night of the crime.

The accused’s mother admitted that at first her daughter’s relationship with the deceased was «very good» and lasted between two and three years. However, she regretted that «they deceived each other.» «Despite that, I put up with them,» she clarified. There came a time when the relationship ended, although she admitted that the two still spoke.

Asked by the prosecutor about her daughter’s character, she emphasized that the accused «does not get angry easily,» does not have to «always do what she wants,» and «is not possessive.» However, the mother told her daughter and the victim that they had a «toxic» relationship and needed to end it.

Her daughter and the victim had resumed their relationship when they went to file a complaint against the other accused for the threats. She pointed out that the other accused and the victim did not have a good relationship, in fact, the accused even threatened the victim and his son, «as evidenced in the audio.»

She also explained that she asked the victim not to answer her daughter’s phone when they had already ended the relationship and asked him to report the other accused. «He told me that the accused constantly threatens him,» she concluded.

However, she denied fearing for the life of the deceased based on what her descendant told her.

On the day of the crime, the witness was with the two accused, who arrived at her house on bicycles around 9:00 p.m. and indicated that their attitude was «good.» «My partner was asleep and did not want to be there at that moment because neither of them liked us,» she said. They asked for a key, but she acted as if she hadn’t heard anything, she said. «They had drunk several liters of beer and I don’t know if they had consumed anything,» she concluded.

She recalled that the two accused were at her house for about an hour and a half, and she did not hear anything from her daughter until the next day, when the Judicial Police showed up at her house. However, she indicated that her daughter told her that the victim had threatened him with a rifle on the same day as the murder.

The witness, who admitted that she was not on good terms with her daughter at that time, acknowledged that this fact may have led her to lie during the investigative phase of the trial. However, she denied that now, as she has a good relationship with the accused again, this could lead her to lie in court.

Finally, the prosecutor requested that the testimony be dismissed for perjury.

Also testifying was the mother of the deceased victim, who recalled that the accused argued a lot with her son and threatened him «a lot» over the phone.

On August 22, she had dinner with her son at her house and then they went to Cartagena to visit a neighbor who was hospitalized. That night, the accused called the victim and said, «If your mom is at home, I will burn her,» said her son, who became «very nervous» because he thought they were going to burn him.

The brother of the deceased recalled that the victim’s relationship with the accused had its ups and downs. «Sometimes it was good, sometimes it was bad, and they threw things at each other,» he declared. When the relationship ended, he revealed that the accused – whom he described as «jealous» – sent «several» text messages and calls to the deceased with death threats and threats to burn the house.

On the day of the incident, he received a call at 5:30 a.m. informing him that his brother’s car had caught fire. «I imagined that my brother was inside, of course,» because «he had been missing since one or two in the morning,» he concluded. «All the bad things done in this life, in the end, are paid for,» he emphasized.

Also testifying was the deceased’s ex-partner – with whom he had a daughter in common – who ended their relationship in 2014, although they maintained a cordial relationship until his ex-partner began a relationship with the accused in 2028. «It became more distant» from that moment on, she pointed out.

The witness recalled that on one occasion she had a problem with the accused because her ex-partner bought a tablet for the daughter they shared and then downloaded an app to play with the little girl. She indicated that the accused did not like this, and one weekend, he grabbed her arm. «I don’t know if he wanted to hit me, to be honest, but he was a minor at that time,» she said.

«I did not report the incident to my ex-partner,» according to the witness, who regretted that if she had, the crime might not have happened.

On the other hand, she explained that the accused «got very involved» in the arguments she had with her ex-partner about the daughter they shared, and it was the accused who sometimes replied to the messages.

She also recounted that it was her daughter who told her that the accused threatened her ex-partner when he did not let him drive the car. Furthermore, her daughter told her that the relationship between the victim and the accused ended because she was unfaithful to him.
