Solicitan 8 años de prisión para ex alcalde de Clavijo por falsificar documentos para obtener autorizaciones de Viñedo

The prosecutor requests a prison sentence of 8 years and a fine of 6,000 euros for the former mayor of Clavijo, accused of two counts of document forgery, in the official document and in commerce, for having forged certain reports to obtain vineyard authorizations in the city of Rioja and for the benefit of two brothers, as well as for Sake.
Apparently, they have altered existing documents or created documents whose content did not correspond to reality to make it appear as if there was an availability of agricultural land that did not match.
According to the prosecutor’s letter, to which Europe Press had access, the events are related to the granting of new plantations by the viticultural distribution of the 2016 surface.
The accused brothers, with the collusion of the mayor of Clavijo, EIA, modified these documents, which were later included in the administrative files «to obtain these vineyard authorizations,» as well as the reports given by the mayor.
The accused, RSL and MSL, modified, among other things, the contract of June 11, 2014, signed between the real estate commitment in Rioja, SL, represented by MSL, and the city of Clavijo.
The prosecutor states that, in the truly signed contract, «the legal rental activity was limited to the 56th of Parcel 222 of Polygon 9, with an area of 2.2006 hectares, that is, 22.006 m2.»
With the modification, the deed indicates: «It seems that the entire surface of Parcel 222 of Polygon 9 will be maintained, including different enclosures.» After that, with this modification, «the modified contract was formal and incongruent from a structural point of view.»
Therefore, the administration imposed on one of the accused «to prove possession of the surface that protects his right» for which the forged document was used.
Subsequently, the accused modified other contracts, signed between the real estate commitment Riojana, SL, and RS L. Where it was stated that the real estate commitment, Riojana SL, claimed to be the owner of the leased farms.
According to these modified contracts, it appeared that the plot had an area of 1,742.204 m2 (174.2204 hectares). In the legitimate contract of June 11, 2014, there was an area of 22,206 m2 (2.2006 hectares).
For his part, the accused of EIA, «strengthened the request to obtain the vineyard authorization by the accused RSL, making the report of May 13, 2016.»
In this way, the former mayor «at the request of one of the accused, made a report mentioned in the official support of the Local Council of Clavijo,» despite knowing about its falsity.
Finally, the administration granted RSL authorizations for vineyard planting, in an area of 20,5080 hectares until the resolution of July 4, 2016, because «a surface availability was granted where it was missing.»
«These maneuvers allowed the accused to obtain, to the detriment of other farmers, a better right.»
For the prosecutor, these facts are components of a crime of forgery in an official document, another in a commercial document, and also require a fraud offense. The former mayor of Clavijo is requested to serve 8 years in prison, and for the other two brothers, a total sentence of 11 years in prison (8 and 3, according to their involvement in the events).
