Prisión provisional para detenido por desaparición temporal de Senegalés

The Court of Instruction of Villacarrillo (Jaén) (Jaén) decided to remand in custody, communicated and without bail, the agricultural entrepreneur arrested in connection with the disappearance and death of Ibrahima Diouf, the young Senegalese man who went missing in January 2021 in this city and was one of his employees.

He is being investigated for the alleged commission of illegal arms offenses, as reported by the Superior Court of Andalusia (TSJA).

The man, who arrived at the judicial units around 10:00, exercised «his constitutional right not to testify,» according to TSJA, who added that «the Court lifted the summary procedure secrecy.» The prosecutor requested the entry of the prisoner, which the judge ultimately agreed to.

It should be noted that his arrest took place on Monday, March 17 during the investigation by the Central Operations Unit (UCO) of the Civil Guard, directed by the Court of First Instance and Number 1 of Villacarrillo.

In these days, agents conducted searches at properties linked to the arrested individuals, such as houses and a garage belonging to his mother, as well as some family-owned houses where the suspect was present. Additionally, in connection with these procedures, his wife was also arrested on Tuesday, although she received charges and was awaiting a court hearing soon.

Ibrahima Diouf had moved to Villacarrillo to work in olive collection. Precisely, the detainee is the agricultural entrepreneur for whom he worked and who has been the focus of repeated searches and investigations related to this case, leading to his investigation.

He is a resident of Villacarrillo, who has previously been investigated for the disappearance in 2013 of another migrant worker, whose search is ongoing, although it was inconclusive in the process.

This arrest marked a significant development in the active investigation by UCO to shed light on what happened to Ibrahima Diouf, the 33-year-old man who was last seen on January 5, 2021 in the aforementioned municipality.

Since his disappearance, UCO has been conducting search operations at properties belonging to the individual under investigation. In the latest fieldwork in June 2023, around thirty agents moved to Villacarrillo. They focused on an area known as Arroyo los Pozuelos, located at the industrial heritage exit of the municipality, as well as other surrounding areas.

The area was meticulously searched, with the assistance of the Canine Service to track any biological traces detected on the ground. A drone was also used to survey the area and access difficult points, such as a high river.

Additionally, in May 2023, the Civil Guard appealed to citizens to provide any clarifying information about the case. At that time, they emphasized the importance of having any photographic or video material recorded on the public road of Villacarrillo between January 5 and 7, 2021. Despite this call for cooperation, there was no breakthrough in the case.

During the initial stages of Ibrahima Diouf’s disappearance, thorough searches were conducted in a garage and a house, with the assistance of canine units. Members of the Underwater Activities Groups (GEA) and the Special Mountain Rescue Intervention Group (Greim) also inspected a well on the property. Subsequently, an olive estate owned by the aforementioned neighbor in Villanueva del Archiepiscop (Jaén) was surveyed.

The individual under investigation had previously been arrested for the disappearance in December 2013 of another migrant worker who worked for him in the olive collection and whose body has not been found.

He was Tidiany Coulibaly, 22 years old, whose whereabouts were lost after he and other immigrant workers in his group had a dispute with the aforementioned agricultural entrepreneur, who had expressed grievances about working conditions in the collection.

Following a trial in 2016 where he was acquitted of the forced disappearance of Tidiany Coulibaly, the Second Section of the Court of Jaén sentenced him to one year in prison and a fine of 4,200 euros for a crime against workers who were «exploited». Additionally, he received a further one and a half years of imprisonment for obstructing justice, along with a fine of 6,000 euros. Furthermore, he was also fined 1,200 euros for electricity fraud.
