The Madrid City Council approved on Thursday at the Government Council to submit to public consultation the preparation of a new ordinance for terraces and kiosks of hospitality and restoration, as explained in a press conference by the deputy mayor and spokesperson of the municipality, Inma Sanz. The consultation will last for 15 calendar days from the publication of this agreement in the Official Bulletin of the Madrid City Council (BOAM).
This new ordinance will replace the one approved in 2022, which was developed to update the existing one up to that date, dating back to 2013, and in a context of relaxation of the COVID-19 pandemic, to provide solutions to the new reality that has been specified and requires special conditions.
In this post-pandemic period, terraces have played a fundamental role, contributing, on the one hand, to the necessary social cohesion and, on the other hand, to the dynamism and economic boost of the sector in a moment of maximum difficulty. Now, in addition to seeking greater legal certainty, the objective is to adapt the ordinance to the current situation, with full normality.
Specifically, the following objectives are pursued: harmonize the regulation of terrace regulations with other more recent sectoral approval regulations (such as the Cultural Heritage Law of the Community of Madrid or the Ordinance on cleanliness of public spaces, waste management and circular economy); establish standards that guarantee the enjoyment of quality leisure time in public spaces with residents’ right to a clean and orderly environment and rest in their neighborhoods and homes; articulate rules and regulations for administrative simplification and efficient tax management and promote the role of the Hospitality and Restaurant Terraces Commission.
Almost all authorized terraces in the city fall within the scope of delegated competencies in the districts, ensuring technical and legal advice in this regard, as well as coordination of criteria in these types of authorizations and proceedings. They support both the Terraces Commission, whose role needs to be strengthened, and the other government bodies attached to the Deputy Mayor’s Area of Governance, Spokespersonship, Security, and Emergency Situations.
The prior public consultation, in which you can participate through the Decide Madrid website, is an opportunity to gather opinions, experiences, needs, and requirements of the sectors involved, especially residents and business owners in the hospitality sector, as well as the opinion of citizens about the future ordinance project, in accordance with the principles of regulatory quality and legal certainty. /
